Terms & Conditions

These terms of business are to protect and clarify the legal rights of our customers as well as ourselves.   

1. Prevailing terms: 

These terms and conditions apply to all crewel orders made to Jan Baker Fabrics. No other terms and conditions can apply in any circumstances. 

2. Statement of liability: 

All goods supplied by Jan Baker Fabrics are supplied on the condition that our liability for any fault or defect in the quality, condition or description is to a sum not exceeding the purchase price of the particular good. All other liability whether statutory or otherwise is excluded.  

3. Products: 

a) We reserve the right to withdraw items from our range at any time without prior notification. 
b) There is a 1 metre minimum order length for fabric. 
c) All orders not confirmed in writing are at the buyer’s own risk. 
d) Half metre returnable samples remain the property of Jan Baker Fabrics. They must be returned within 28 days of receipt otherwise they will be invoiced at the price of half a metre of that fabric. 
e) Colour or finish matching: for exact colour or finish matching request a stock cutting as colours and finishes can vary from batch to batch.  f) Fitness for purpose: the buyer must satisfy themselves that any product supplied by Jan Baker Fabrics is fit for the purpose for which it is purchased prior to ordering. 

4. Payment: 

a) Payment in full for all retail fabric orders is required before goods are cut and despatched.  
b) Invoices must be fully paid before goods are cut and despatched. 
c) Once full payment is received and goods are despatched they become the property of the buyer. 

5. Delivery: 

a) The full delivery address must be given when the order is placed.  
b) It is the buyer’s responsibility to check for any damages to packing materials and product before accepting delivery of the products, and to report any damage by the delivery company to Jan Baker Fabrics within 48 hours. In the unlikely event that there is any damage, please DO NOT accept delivery, DO NOT sign the delivery sheet; instead ask the driver for a damaged freight report which will need your signature. Contact us as soon as possible and in any event within 48 hours. Jan Baker Fabrics sends out goods with Parcelforce on a 48 hour service, if the goods are delayed in transit it is beyond our control and postage refunds will not be given. Transit insurance will be provided at the customer’s request and expense, at standard Parcelforce rates.
d) It is the responsibility of the buyer to ensure that the correct product has been delivered to any other third party such as an upholsterer or curtain maker. Jan Baker Fabrics will not be liable for any costs incurred in the unlikely event that the correct product is not delivered.
e) Delivery dates supplied by Jan Baker Fabrics are estimates. We are not liable for the consequence of any delay. We will endeavour to keep you informed of any delays. 

6. Cancellations: 

a) Whilst every effort will be made to accept a cancellation this can only happen if cancellation is made prior to any cutting of fabric. If cutting or production has begun then a 50% deposit will be kept.
b) For bespoke fabrics cancellation is not possible if product has already gone into production.  
c) Cancellations should be made in writing. 

7. Returns: 

a) Returns cannot be accepted unless by prior agreement. 
b) Unauthorised returns will not be credited to the customer's account. 
c) Returns of bespoke fabrics will only be accepted where products are found to be faulty or damaged on receipt of products and the fault or damage is reported in accordance with Clause 5 above, or Clause 8 below, whichever is appropriate.  
d) If measurements have been taken by the buyer then it is the buyer’s responsibility to ensure that correct measurements are given when placing order. All measurements and instructions will require the signature of the buyer prior to the order commencing.

8. Claims: 

a) Non-receipt of goods: Any claim for the non-receipt of goods must be made in writing within a maximum of 14 days from the date of the confirmed delivery date. 
b) Errors, omissions, faults and damage: Customers should check all deliveries immediately for shortages, faults, damages or incorrect products. Trade buyers must inform Jan Baker Fabrics in writing, within 14 days of the date of delivery. Retail buyers must inform Jan Baker Fabrics within 7 days of the date of delivery.
c) No claim will be considered in any circumstances should the goods have been cut, modified or damaged by buyer in any way. 
d) It is a characteristic of natural textiles that there will be variations in the weave, colour and texture including occasional slubs and as such claims for irregularities will not be accepted under any circumstances. The sample you order may come from a different batch to the material you receive. 
e) Claims for labour charges will not be accepted under any circumstances.

9. Entire Agreement:

a) These Terms and Conditions set out the entire agreement between the buyer and Jan Baker Fabrics and no other representations, warranties, discussions or arrangements shall alter these Terms and Conditions in any way, save that the price, specifications and other details set out in the Pro Forma Quote shall form part of the agreement between the buyer and Jan Baker Fabrics and shall be subject to these Terms and Conditions.

10. Law and Jurisdiction:

a) These Terms and Conditions are subject to the law of England and Wales.
b) Any dispute arising out of, under or connected with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
